Car dealer Khalif Kairo gets out-of-court settlement deal in Ksh.5.9M fraud cases

Two fraud cases against Nairobi car dealer Joseph Kairo Wambui better known as Khalif Kairo have been withdrawn following an out-of-court settlement.

The cases were dropped on Monday before Milimani Chief Magistrate Lucas Onyina, after the complainants in the Ksh.5.9 million fraud cases confirmed that they had received full reimbursement from Kairo.

“My client has refunded the complainants through their advocate, and they are not pursuing the cases further,” Kairo’s defence team told the court.

Magistrate Onyina subsequently ordered the withdrawal of the charges under Section 204 of the Penal Code, which allows criminal proceedings to be terminated where parties reach a mutual agreement.

In one of the cases, Kairo, through his firm Kai & Karo Limited, was accused of defrauding Dona Ayalo Okoth of Ksh2.98 million under the guise of importing a Subaru Outback between July and November 2024. The vehicle was never delivered despite payment being made into the company’s KCB account.

In the second case, the businessman allegedly obtained Ksh.2.15 million from Jeff Kyule Munane in a similar vehicle import scheme. The funds were meant to facilitate the purchase of a Honda Vezel Hybrid from Japan, which also failed to materialize.

Kairo had initially denied all charges when they were filed in court.

However, the court was informed that a third case against him is still pending, with negotiations ongoing. That matter is scheduled to be mentioned in December 2025.
