Court orders state to produce key documents in Riruta–Ngong railway project

The Riruta–Ngong project is a 12.5 km commuter meter-gauge railway (MGR) designed to decongest Nairobi's Ngong Road and is expected to cut travel time to the CBD.
In its ruling, the court ordered that the interim orders earlier issued to suspend the project shall remain in effect pending the hearing and determination of the case, unless otherwise vacated.
The judge further issued mandatory orders compelling the government to, within 30 days, furnish the court with verified copies of critical records tied to the project.
These include the feasibility study report for the Riruta–Ngong project, as well as engineering, procurement and construction contracts, together with any financing agreements associated with the development.
The government is also required to submit minutes of meetings relating to the project, all parliamentary approvals sanctioning the allocation of funds, and media advertisements demonstrating that public participation was undertaken.
Additionally, the court directed that cabinet memoranda and approvals linked to the project be made available, alongside any loan agreements, liabilities, financial arrangements, or other instruments used to finance the project.
The orders come amid growing scrutiny over the planning, financing, and implementation of the Riruta–Ngong road project, with petitioners raising concerns over transparency, accountability, and adherence to legal procedures.
