Court remands 3 suspects accused of beating and burning three men to death in Machakos

Three men accused of lynching and burning three young men to death in Machakos town have been remanded at Machakos GK Prison after pleading not guilty to three counts of murder.

Christopher Mwenda Robert, Dominic Muinde Paul and Francis Mutinda Kimeu appeared before High Court Judge Josephine Mong'are, where they denied murdering Charles Kioko Mutiso, Kennedy Katuu Muthungu and Stanley Mbithi Muthungu during the May 31, 2026 mob justice incident.

Justice Mong'are ordered the three to remain in custody for 30 days pending the preparation of a probation report to determine whether they qualify for bail or bond.

The court's decision followed objections by the prosecution and lawyers representing the victims' families, who argued that releasing the suspects could jeopardise the case.

State Counsel Dennis Mang'are opposed the bail application, citing an affidavit filed by investigating officer DCIO Henry Rabala, arguing that the suspects were likely to interfere with investigations.

The victims' lawyer, Advocate Mutava Musyoki, also urged the court to deny the accused bail, saying they posed a flight risk and could interfere with witnesses and investigations.

Defence lawyer Gift Muteti had asked the court to grant the accused favourable bail or bond terms.

Justice Mong'are directed that the probation report be filed within 30 days. She also ordered the Office of the Director of Public Prosecutions (ODPP) to file its affidavit opposing bail, with the defence required to respond before the matter is considered.

The case will be mentioned on September 7, 2026, to confirm compliance with the court's directions, while the hearing has been scheduled for June 7, 8 and 9, 2027.

The three suspects are among six people initially arrested over the killings. Last month, a Machakos court freed Keith Mutuku Muli, Esther Mumbua Mwololo and Yussuf Said after finding insufficient evidence to charge them.

The case against Mwenda, Mutinda and Muinde was, however, transferred to the High Court after the Director of Public Prosecutions approved murder charges against the trio.

The case stems from the deaths of Kennedy Mutiso, 29, his younger brother Stanley Muthungu, 22, and their family friend Charles Mutiso, 25, who were lynched and set ablaze by a mob in Machakos town on the night of May 31.

While initial reports suggested the three had attempted to rob a miraa trader after posing as passengers, investigators later alleged the victims had been walking home after watching the UEFA Champions League final when one of them was struck by a Probox vehicle.

According to investigators, Christopher Mwenda, the driver of the vehicle, allegedly raised a false alarm claiming he was being carjacked, prompting boda boda riders and members of the public to descend on the three men.

The victims were allegedly beaten, doused with petrol and set ablaze before police launched investigations that culminated in the arrest of the suspects.
