DPP dismisses report on recommendation to prosecute Governor Waiguru

The Office of the Director of Public Prosecutions (ODPP) has dismissed report claiming that it is currently in possession of a file from the Ethics and Anti-Corruption Commission (EACC) recommending the prosecution of Kirinyaga Governor Anne Waiguru over the alleged irregular receipt of imprest amounting to Ksh.10,634,614.

In a statement issued on Tuesday, Acting Director of Public Prosecutions Grace Murungi said the matter is still under investigation by the EACC hence a final decision on prosecution is yet to be made.

She stated that the file was returned to EACC and received by the anti-graft body on April 1, 2022, with a recommendation for further probe on certain issues.

“On 7th December 2021, the ODPP received an inquiry in relation to an inquiry into allegations of abuse of office for irregular receipt of imprest amounting to Kshs.10,634,614 against Kirinyaga County Governor Ann Waiguru.  Consequently, vide a letter dated 25th March 2022, the ODPP communicated to the EACC the critical areas that require further investigations before a final decision can be made on the matter," noted the DPP.

“The ODPP would like to clarify that the Kirinyaga County Governor Ann Waiguru's file has since been returned to the EACC and is under active investigation; this is contrary to reports in the People Daily dated 28th June 2022 that the file is at the ODPP.” 

The DPP’s office noted that investigations are still ongoing in regard to the matter and is awaiting the outcome of the investigations before a decision can be made.

“It is paramount to note that, the ODPP bears a Constitutional obligation to ensure that in every case, investigations are completed and the evidential and legal thresholds are met before making a decision to charge," said the DPP's office.

Governor Waiguru is on record dismissing the allegations that she received imprest for foreign trips that she never made.
