The Director of Public Prosecutions (DPP) has directed the Directorate of Criminal Investigations (DCI) to conduct thorough investigations into the collapse of a multi-storey building in Eastleigh, Nairobi, warning that action will be taken against persons liable.

In a press statement on October 26, 2026, the Office of the Director of Public Prosecutions (ODPP) said the investigation is meant to establish the circumstances surrounding the collapse, which has caused injuries, property damage and left some people missing.

The prosecutor said the Nairobi City County Government had not forwarded any inquiry file to the ODPP concerning possible wrongdoing by the private developer, construction professionals or county officials involved in the building project.

“As of the date of this statement, no inquiry file relating to the construction of the building has ever been forwarded to the Office by the Nairobi City County Government,” the ODPP said in a press statement.

The investigations will examine whether any acts or omissions by county officials, the developer, contractors or other professionals involved in the planning, approval, supervision and construction of the building contributed to the collapse.

The ODPP said it would take the necessary action against any persons found responsible if sufficient evidence shows criminal culpability, regardless of their position or status.

“Where sufficient evidence establishes criminal culpability, the ODPP shall take the necessary prosecutorial action against any persons found responsible, irrespective of their position or status,” the office said.

The office also expressed sympathy to those injured and people who suffered property losses following the incident.

It further cautioned developers, contractors, construction professionals and relevant public officials against disregarding building regulations, safety standards and statutory approval requirements.

The DPP warned that any conduct amounting to a criminal offence would be dealt with in accordance with the law.

The ODPP reassured its commitment to accountability, the rule of law and the independent discharge of its constitutional mandate, adding that it would continue working with investigative agencies to ensure that cases warranting prosecution are addressed in accordance with the law.
