Through their lawyer, Danstan Omari, the family revealed that Mwathi was buried twice, an ordeal they said intensified their grief and prolonged their suffering.
They expressed willingness to appear in court at any time to ensure the matter is heard and concluded without unnecessary delays, seeking closure.
The court heard that some witnesses in the case are public figures whose daily lives have been disrupted by the prolonged proceedings.
These witnesses are reportedly eager for the matter to be resolved.
In response, the court acknowledged that the case is of public interest and noted that delays have caused continued anguish to the family and other parties involved.
The court assured that adequate facilities would be made available to facilitate the swift disposal of the case.
The matter was adjourned for the day, with the prosecution directed to inform the defence of the evidence it intends to rely on.
The case was subsequently removed from the day’s cause list.
