Kitutu Chache Constituency Member of Parliament Anthony Kibagendi has been arraigned and granted a Ksh.100,000 cash bail over an alleged assault.
Appearing before Narok Resident Magistrate Ester Mwikali
Mutuku, Kibagendi was charged with assaulting Asterico Omariba on November 27
last year within Kisii town, causing him bodily harm.
The case was initially filed at a Kisii court but was later
transferred to Narok. It is alleged that the accused had earlier been granted a
Ksh.50,000 bond under different terms.
The defence team, led by Kisii Senator Okong’o Omogeni,
raised concerns over the alleged misuse of public resources, claiming they were
unnecessarily taken in circles while tracing their client.
Speaking to the media outside the court, the defence team
decried what they termed as harassment of the accused.
“We have seen abuse of power by the state, as he was
arrested by contigent of six vehicles, taken around in Nairobi, driven to Nyamira
and finally spent his night in Keroka Police Station, just the way the previous
regime used to behave,” said Kisii senator Okong’o Omogeni
“Kibagendi was out on cash bail granted by the high court, but the DCI, ODPP and even the CS did not want to respect the court order, and
that is why they brought him from Nairobi. This is harassment, and we condemn
it.”
The case will resume for hearing in the same court on March
2 this year.
"The reason why we say one term is because of some of these things; we are saddened by the harassment meted at our MP. He was arrested and arraigned, then today he was rearrested on the same matter that took him to court,” said Narok Town ward MCA Douglas Masikonde.
“That is impunity, and we are not going to allow it to continue happening. So let us stand firm.”
The MP was dramatically arrested by Directorate of Criminal Investigations (DCI) detectives from Muthaiga Police Station on Tuesday.
Taking to his official Facebook account, Kibagendi claimed he had been forcefully
apprehended and detained in Muthaiga.
"I have been aggressively blocked by DCI officers and arrested. Being taken to DCI HQS, Muthaiga Police Station," he wrote.
Even though the MP did not disclose the reason for the
arrest, he is accused of assault, where
the lawmaker was captured by CCTV beating up a local political operative, Enock
Omariba.
In the viral video dated November 2025, Kibagendi was seen storming a restaurant in Kisii town, kicking and beating up the man as people tried to separate them.
