Maraga calls for revocation of Kenyan passport issued to RSF Commander Hemedti's brother

Former Chief Justice David Maraga has condemned the alleged issuance of a Kenyan passport to Algoney Hamdan Dagalo Musa, the younger brother of Mohamed Hamdan Dagalo, also known as 'Hemedti,' warning that the matter could trigger a diplomatic crisis if proven true.

Musa, a senior Rapid Support Forces (RSF) logistics operative, is under sanction by the United States Treasury's Office of Foreign Assets Control and the European Union. 

In a statement dated Thursday, February 26, Maraga described the development as “alarming,” arguing that it undermines Kenya’s neutrality in the ongoing Sudan conflict.

"This disclosure, highlighted by international and local media, not only undermines Kenya's asserted neutrality in Sudan’s civil war but also exposes potential complicity in enabling atrocities, including the assault on El Fasher that United Nations experts have described as bearing the 'hallmarks of genocide,’” he said.

The 2027 presidential candidate warned that, if confirmed, the issuance of the passport points to a profound constitutional crisis.

He also raised concerns that the alleged move could damage Kenya’s standing as a regional mediator under the Intergovernmental Authority on Development (IGAD), warning that it risks eroding trust and weakening the credibility of Kenyan travel documents globally.

“Such actions erode trust in Kenya’s role as a regional mediator under the IGAD framework and risk tarnishing our nation’s international standing, potentially leading to degraded passport credibility globally,” he stated.

Maraga further argued that Kenyan citizenship should not be issued arbitrarily, emphasizing that a passport represents sovereignty and legal accountability.

“A passport is not just a travel document, it is the State’s declaration that the bearer is one of us, bound to our Constitution, protected by our laws, and accountable to our institutions,” he stated.

He called on the government to immediately revoke the passport in question and urged the Ethics and Anti-Corruption Commission (EACC) and the Directorate of Criminal Investigations (DCI) to probe immigration officials and any high-level actors who may have facilitated the process.

Maraga also urged Kenyans, policymakers, and the international community to demand accountability, warning that the country’s reputation and sovereignty are at stake.

The allegations come amid broader scrutiny over Kenya’s engagement in Sudan, including claims by Sudanese authorities that Nairobi has hosted individuals linked to the RSF, claims that the government refuted.

"It is important at this juncture to reiterate that no parallel government for Sudan was formed in Nairobi. Kenya abhors the balkanization of sovereign states and supports a unified Sudan for the people of the Sudan," Prime CS Musalia Mudavadi stated on April 8, 2025. 

"Notably, the Nairobi meeting was not an RSF-only conference; there were more than 24 political and civilian organizations reflecting the wide diversity and hunger for peace in the Sudan beyond a contestation between the Sudanese Armed Forces and RSF."
