A legal showdown is looming between Nakuru Governor Susan Kihika and County Senator Tabitha Keroche over what the governor has termed as “personalised attacks on her person and her family” under the guise of oversight.

In a demand letter drafted by Senior Counsel Ahmednasir Abdullahi, Governor Kihika accuses the senator of making false statements against her.

“It is our further instruction that your imputations about our client were actuated by naked malice and ill will,” reads part of the demand letter.

In the letter, Governor Kihika demands a retraction of claims that she used county funds to construct a state-of-the-art luxurious hotel in Nakuru, adjacent to the Nakuru State Lodge.

“Your remarks were expressly calculated to injure our client and subject her to hatred,” notes the letter sent to Senator Tabitha Keroche.

In the escalating confrontation with her senator, Governor Kihika said the remarks are a distortion of the truth and a wild fantasy that does not amount to proper oversight.

Governor Kihika denied any misappropriation of public funds or involvement in fraudulent activities, claiming the senator is engaging in falsehoods and hearsay disguised as oversight.

However, the Nakuru senator has termed the legal action as intimidation, saying, “Bring it on.”

The demand letter, dispatched on January 8, lapses in seven days. Failure to retract the remarks within the stipulated period will see Governor Kihika institute “legal remedies including, but not limited to, civil proceedings for defamation seeking general, aggravated and exemplary damages, injunctive relief, or any other orders the court may deem fit.”
