West Kenya Sugar Company seeks to be enjoined in Mumias lease case, claim they were the highest bidders

Through lawyer Paul Muite, the company told the court that there are several cases that have been filed that are similar adding that West Kenya Sugar Company was the highest bidder with Ksh.36 billion compared to Sarrai Group.

In an affidavit filed in court, the company claims that through the entire process leading to tendering of the bids, opening and evaluation, the first defendant has conducted himself in a manner devoid of transparency and accountability.

“It is in the interest of justice that the application is allowed and West Kenya is enjoined in these proceedings as the 6th plaintiff..,”reads the court papers

The company further claimed that the leasing of the sugar plant and related assets belonging to Munias Sugar Company to Sarrai; the lowest bidder, was undertaken in a manner that fell short of accountability.

Lawyer Muite said that the company (West Kenya) will be seeking an explanation from KCB and the receiver manager on the same.

However, lawyer James Orengo representing Kakamega County said that they should be given time to file their responses on the issues of who was the highest bidder and who was not.

 Other parties who have also asked the court to be enjoined in the case include the Guatambu Farmers, Mumias Outgrowers Company Limited want to be a plaintiff and Tumaz Tumaz Enterprises Limited (Interested Party).

Meanwhile, the court was told that Sarrai company has been going on with works at the company despite court orders 

Lawyer Kibe Mungai said that the court should take note that Sarrai is still operating adding that they have credible information that the machinery of the sugar plant is being placed in jeopardy.

 The orders stopping any works at the company lapsed on Monday.
