Amber Ray threatens to sue Instagram influencer Madollar Mapesa for defamation

Kenyan socialite Faith Makua, popularly known
as Amber Ray, has threatened to sue an Instagram influencer going by the name Madollar
Mapesa over alleged defamatory remarks.
Amber, in a demand letter seen by Citizen
Digital, claims Mapesa on June 24, 2022 published material on his Instagram
account insinuation that he was previously involved in a romantic relationship
with the socialite and that she is a street beggar.
Amber also claims that Mapesa intimated that she
engages in prostitution for money, has a deformed body hence is unfit to work
as an influencer, and is an unprofessional person who misleads her social media
followers and business partners.
Further, the socialite expressed deep
discomfort and rage that Mapesa reportedly dragged her child name’s name in his
social media antics, thereby amounting to breach of the minor’s privacy.
We refer to the above matter in which we act
for Sh. Faith Makau alias 'Amber Ray% Our them , herein with instructions to
address you as hereunder.
“We are therefore instructed by our client to
demand, which we hereby do, that you forthwith admit liability in wilting to be
published in a manner acceptable to our client and issue a formal apology
within 7 (Seven) days of receipt of this demand,” read the letter drafted by
Kazi Advocates LLP.
“Take notice that if we do not receive from
you an admission of liability and cooperation in publishing an apology to be
shared with members of the public…we have firm instructions to proceed and institute
legal proceedings against you without further notice to you as to the consequences
that arise thereafter.”
The law firm further wrote to the Directorate
of Criminal Investigations (DCI) requesting a probe into the said allegations
by Mapesa against Amber.
In the letter, Amber Ray claims to have no
knowledge of, or association with, Mapesa; completely distancing herself from
him and his lifestyle.
“The perpetrator operates under a username ‘Madollar_mapesa'…The
said profile picture indicates a male figure whose appearance is completely
unfamiliar to our client. Additionally, our client does not wish to be
associated with the lifestyle mantras portrayed by the referenced perpetrator
as so intended by him,” read the letter.
“We therefore humbly request that an
investigation be launched to identify the perpetrator. Investigate our client's
complaints and where necessary charge the offender as per the outcome of your
investigations. This targeted attack to malign our client and mislead the
public with false information should be deterred in the interests of justice.”
The law firm further added: “We are also of
the firm opinion that women should not be improperly targeted on account of
their gender and the nature of work that they engage in and as such hope that
the Directorate holds similar views in relation to protecting women from such
demeaning abuse and infringement of Constitutional rights.”
