22-year-old man jailed for 7 years for attempted rape

The Director of Public Prosecution in a statement on Wednesday said Mombasa Senior Resident Magistrate Gladys Ollimo ruled that the prosecution led by Counsel Hilary Isiaho proved their case beyond reasonable doubt against the accused Stephen David Muasya.

The DPP says Magistrate Ollimo further noted that the five prosecution witnesses, including the victim gave corroborative testimonies against the convict. 

“The particulars are that on 9th February 2023 at Consolata area in Likoni Sub-County within Mombasa County, he unlawfully and intentionally attempted to rape the complainant, contrary to Section 4 of the Sexual Offenses Act No. 3 of 2006,” stated the DPP.

During the hearing, the court dismissed Muasya’s claim that he was framed, terming it ‘an afterthought and unrealistic’. 

The court also ruled that the sentence would serve as a deterrent measure amid the prevalence of sexual and gender-based crimes in society.

According to the DPP, the accused attacked the woman as she walked home from dropping her daughter off at the school on February 9, this year in Consolata area in Likoni.
