The Milimani Magistrate Court has dismissed claims by Mumias
East Member of Parliament Peter Salasya that he was subjected to torture while
in police custody.
Principal Magistrate Peter Mutai, presiding over the case,
ruled that the court lacks jurisdiction to release exhibits at this stage,
maintaining that due process must be followed.
Salasya, who was charged with hate speech on
May 19, 2025, secured his release on a cash bail of Ksh.200,000.
The court has directed that the case proceed to pre-trial on
June 16, 2025.
"It's my finding that this court lacks jurisdiction for
the direct release of exhibits until it is formally produced. The accused,
however, has a right to protection by the State and should be accorded security
within the established protocols," said Mutai.
Salasya was arrested dramatically in
May during a tour of Isiolo and taken into custody in Nairobi.
He said men claiming to be officers from th edIrectorate of
Criminal Investigations (DCI) attacked his convoy, shot at him before taking
him into custody.
In a series of tweets posted on his official X account, he
detailed that the masked men, about 15 in number, who were heavily armed with
AK-47 rifles, intercepted his convoy along the highway after his Isiolo tour.
They allegedly opened fire, deflating his vehicle's tyres
before disarming his security team.
