CJ Maraga suspends mentions of cases of persons in remand

Chief Justice David Maraga has suspended mentions of cases of persons in remand for 30 days effective from March 16, 2020 due to the coronavirus crisis.

Maraga, in a statement released on Monday, said the move was further to a previous communique by the National Council for Administration of Justice on the ways of mitigating the spread of Covid-19.

He also stated that no precipitate action will be ordered in respect of existing interim orders, instead urging parties to extend them by consent.

The Chief Justice further directed all court registries to accept filing of all pleadings.

“Dates shall be given, on a priority basis, for mention of the matters affected by the suspension as soon as the situation normalizes,” he added.

The National Council for the Administration of Justice on Sunday resolved to scale down operations and suspend open court sessions over the next two weeks as part of measures to prevent spread of the coronavirus disease.

The Judiciary also resolved that during the two-week period, with regard to new arrests, all cases except serious ones will be dealt with at the police stations in accordance with guidelines to be issued by the Inspector General of Police.
