Court bars newly-elected Chamber of Commerce officials from assuming office

Newly-elected Kenya National Chamber of Commerce and Industry president Eric Rutto.

A Commercial court has issued an order restraining the newly-elected leaders of Kenya National Chamber of Commerce and Industry from assuming office. 

Dr Eric Rutto (President) and Mustapha Ramadhan (Vice President) have been barred from assuming their respective positions pending hearing and determination of a case against them. 

In the case, Hassan Wario moved to court and sued the chairman of the Independent Electoral Board of the chamber, alleging that the elections were marred with irregularities. 

"A temporary injunction is issued restraining the third defendant from engaging in any activities related to the filed returns. The injunction explicitly prohibits the third defendant, as well as their agents, employees, servants, or any other individuals acting on their behalf, from dealing with, filing, registering, presenting for registration, or applying for registration based on the returns filed by the first defendant," the court order reads.

The order issued by the court on June 19 temporarily stops their ascending in leadership pending further directions.

The court further directed that the application be served to the parties, who will respond within 14 days. The court will give directions on July 3.

Dr Eric Rutto and Mustafa Ramadhan beat the incumbent Chamber President Richard Ngatia and his running mate Abdulwalli Shariff garnering 291 against 208 votes.
