High Court has issued orders restraining businessman Kung’u Muigai from making or publishing any further defamatory statements against Supreme Court Judge Isaac Lenaola.

Justice Nixon Sifuna directed that the application be served within two days, with a response expected within five days of service.

The Applicant will be allowed to file a supplementary affidavit, if necessary, within three days after receiving the response. The matter will then proceed by way of written submissions, with a mention set for October 13, 2025 to give further directions.

Meanwhile, the court granted an interim injunction stopping Muigai, or anyone acting on his behalf, from publishing in any media or platform statements deemed defamatory against Justice Lenaola.

The orders were issued after Justice Lenaola, through his lawyers Ngeri, Omiti & Bush Advocates LLP, filed a certificate of urgency accusing Muigai of making false, scandalous, and malicious allegations.

According to court documents, Muigai allegedly gave video interviews on September 8 and September 12, 2025, which were later allegedly circulated on various social media platforms

The judge accuses Muigai of linking him and other senior judges to corruption and even insinuating their involvement in the death of lawyer Kyalo Mbobu.

"... despite a demand notice requiring him to retract the statements, Muigai continued with fresh interviews, repeating the allegations and daring Justice Lenaola to sue him," reads court papers.

The judge argues that such continued attacks not only injure his personal reputation but also undermine the integrity of the Judiciary, which heavily relies on public trust.
