This is after the Court of Appeal delivered a decision saying that the order by the High Court for a retrial was not proper or legal in the circumstances.
Following the decision by the appellate court, the judge said that the matter had been overtaken by events and marked it as closed.
“This matter is overtaken by events and is therefore closed,” court noted.
It was the appellate decision that charges against Waiganjo be quashed and that he be set at liberty forthwith unless otherwise lawfully held.
Waiganjo was in 2020 acquitted of charges of impersonating a senior police officer. He was alleged to have masqueraded as an assistant police officer on diverse dates between June and December 2012.
