Court Nullifies IEBC Order On Homa Bay Nominations
The high court order now gives ODM a chance to conduct proper nomination exercise after the Monday one aborted due to chaos
The party, which is dominant in Homa Bay is expected to win the by election owing to fanatical support it has in the area
The court order follows an application by a member of ODM Kenneth Ogalo who said the time given by IEBC was inadequate to conduct a fair and free nomination exercise
ODM leadership has in the recent past pleaded with IEBC to extend the nomination period beyond 19th Dec 2014 to allow it carry out the nomination
Earlier today before the High Court order was issued, ODM elections board said it will hand a direct nomination to one of the seven aspirants who are eyeing the party ticket on Friday this week
This was after the aspirants failed to agree on a compromise candidate to face others in the February by election.
The High Court order was issued by Justice George Odunga who said that IEBC should have given parties enough time to present their nominees.
IEBC gave all parties 10 days to pick their flagbearers to face each other during the by election to replace Otieno Kajwang who died on 18th November
The petitioner in the case Ogalo complained that the inadequate time posed a challenge for all parties to come up with a suitable candidate for the vacant seat.
