Court Of Appeal Nullifies Kidero’s Election

The three judge bench ruled that the High Court did not give Ferdinand Waititu, the petitioner, a fair hearing.

 

The judges further pointed out the High Court further disallowed the cross examination of the Nairobi’s IEBC returning officer in the last election.

 

The judges also noted that the High Court did not allow the scrutiny of votes.

 

The three judge bench comprised of GBM Kariuki, Mohamed Warsame and Peter Kiage.

 

However, one judge dissented from the ruling.

 

The case had earlier on been dismissed at the High Court by Justice Richard Mwongo.

 

Former Embakasi MP Ferdinand Waititu thereafter moved to the Court of Appeal seeking to reverse the judgment by the High Court which dismissed his petition challenging the election of Nairobi governor Evans Kidero.
