Court to rule on withdrawing Ksh.7.5B fraud case against DP Gachagua

The anti-corruption court will on Thursday, November 10 deliver a ruling on
whether it will withdraw a fraud case against Deputy President Rigathi Gachagua
and others.
This is after the prosecution made an
application to have the case withdrawn on grounds that investigations into the
case are not complete.
According to the prosecution, it will be
prejudicial for the case to go on as it is.
While relying on an affidavit by
investigator Obadia Kuria, the Director of Public Prosecutions (DPP) told the trial magistrate that the evidence
does not meet the threshold required to amount to a successful prosecution of
the case.
The DPP wants the case withdrawn under
section 87 A of the criminal procedure code.
The section allows for the DPP to arrest
and charge the suspects over the same offence once they find new evidence.
