Criminal case against imprisoned Waititu to be heard next week

Former Kiambu Governor Ferdinand Ndung’u Waititu continues to face legal challenges, with the hearing for his 2024 criminal case now pushed to next week.

Waititu, who is currently serving a sentence for corruption-related offences at Kamiti Maximum Prison, was charged over remarks he allegedly made on September 29, 2024, at Ruiru Stadium in Kiambu County. 

According to the charge sheet dated October 1, 2024, the statements, directed at groups including hustlers, market vendors, boda boda operators, clergy, and teachers, were intended to provoke a breach of the peace and suggested violent outcomes against political figures.

In his speech, Waititu appeared to condemn President William Ruto over the impeachment motion against former Deputy President Rigathi Gachagua, saying, “If Gachagua goes home, Ruto will also go home.” 

The alleged conduct is said to contravene Section 94(1) of the Penal Code, which prohibits offensive conduct likely to incite public unrest.

Prosecution allege that Waititu made the statements publicly with the aim of creating tension among the audience.

While the former governor has already been formally charged, the court has now pushed the hearing to next week.

Waititu remains in custody as the Office of the Director of Public Prosecutions (ODPP) pursues the matter.
