Echesa now wants DPP to institute private prosecution against Governor Barasa

Former Cabinet Secretary Rashid Echesa now says he will write to the Director of Public Prosecutions (DPP) to institute a private prosecution against Kakamega Governor Fernandes Baraza.

He claims that he filed a complaint against the Kakamega Boss but no action was taken. He now says that he will write to the DPP with the aim of having Governor charged.

Echesa, who is accused of an extortion targeting Barasa was on Wednesday granted a personal bond of Ksh.2 million and directed to appear before the police once he is discharged from hospital before April 23,2024.

The police were however barred from arresting Echesa.

"Echesa is still in hospital and he will continue to be in hospital until when the doctors are convinced the he has recovered, so let it not be expected that he has been released on bond he's going to be out of Karen hospital," said his lawyers Danstan Omari and Clif Ombeta 

According to court documents seen by Citizen Digital on Wednesday, the court granted the ex-CS bail applications citing a violation of his rights to liberty under Article 29 of the constitution.

“The applicant be and is hereby admitted to bail pending hearing of the application inter partes…the applicant to execute a personal bond of Ksh. 2 million,” stated the documents in part.

The court in its orders directed Echesa to be presented to the DCI offices for questioning before April 23, 2024.

“The applicant shall be escorted to the offices of the 1st respondent by his advocate as soon as he is discharged from the hospital and not later than the 22nd of April 2024 for interrogation and/or questioning and, he shall cooperate with the investigators during the entire period of investigations,” stated the judge.

The judge granted the orders sought by the applicants arguing that the submission that Echesa had been unlawfully arrested while obeying lawful summons by the DCI and that his health was also at risk could warrant the court to protect his fundamental freedoms. 

The court also said that the police are free to investigate Echesa.
