Embarambamba protests KFCB's Ksh.6M penalty, says 'Niko Uchi' song was targeting the deaf

Controversial gospel singer Christopher Mosioma alias Embarambamba has written a letter to the Kenya Film Classification Board (KFCB) seeking to have its decision to ban his music re-considered.

In the letter, the musician says the decision also to have him pay a penalty of Ksh.6.4 million is "hostile and discriminative."

“While there are numerous musicians using different combinations of words as an expression of their creativity in different contexts e.g Mali safi chito, it is not apparent why you have opted to single out and only call out our client for his use of the word 'Niko Uchi'," reads the letter.

He argues that the decision by KFCB was influenced by bias and contempt towards him.

The singer, through lawyer Danstan Omari, says that he is a minister of God and his creative works have been done to minister the Gospel and win souls for God.

"One of the songs in issue, "Niko Uchi" forms part of his genius creations aimed at reaching the deaf who lack the ability to hear his message but are nonetheless able to understand the message from the pictures and scenes of the song."

“It is thus shocking and bewildering that instead of celebrating our clients' creativity and genius ideas of ministry, you have resolved to discourage and intimidate him by making very scandalous and unmerited demands," the letter continues.

Last week KFCB directed the singer to delete all music videos uploaded on his YouTube channel and other social media platforms within the remaining two days of their earlier demand notice.

KFCB acting CEO Nelly Muluka said the songs titled ‘Niko Uchi’ and ‘Yesu Ninyandue’ respectively contravene the law and threaten the safety of children and the general public at large.
