Former KBC boss Naim Bilal wants ICT CS Eliud Owalo jailed

Former Kenya Broadcasting Corporation (KBC)
Managing Director Dr. Naim Bilal has moved to court seeking to have Information, Communication and the Digital Economy Cabinet Secretary Eliud Owalo committed
to civil jail for disobedience of court orders.
In his notice of motion, Dr. Bilal says that
the CS - under whose docket KBC falls - has not implemented a court order directing
that he be reappointed as the State broadcaster's MD.
He points out that the order for his
reappointment was issued on October 31 this year and that the Public Service Commission
(PSC) and the ICT Cabinet Secretary were served with copies of the order on November
8.
According to Dr. Bilal, however, the court order is yet to be implemented to date, and that the CS has refused to obey it.
Dr. Bilal took the CS, Head of Public Service
and the Attorney General to court over failure to renew his contract as KBC
Managing Director.
The court ruled that he had a legitimate
expectation to have his contract renewed in March this year and that the
respondents had violated his rights.
The court, in a judgment by Justice Ocharo Kebira,
also restrained the ICT CS and Public Service Commission from recruiting any
other person for the position.
The court ordered the CS to reappoint Dr. Bilal
as KBC MD and decided in his favor on costs.
