Govt yet to track down, quarantine the 239 passengers from Chinese plane

High Court judge James Makau has directed the government to file a report on the actions it is taking in the coronavirus case filed by two doctors.

“We should get a report as to the position so far. This is a serious matter. It’s an issue of life and death,” said the judge.

In the case, two doctors moved to court seeking to have the Government blocked from allowing entry of any passengers from China or any other World Health Organisation (WHO)-designated hotspot.

During Tuesday’s mention, the lawyer for the two doctors told the court that the State is yet to ensure that the passengers are traced, accounted for, re-examined and then quarantined either at the KDF facility or another specially guarded unit.

The State, through the State counsel Emmanuel Bitta, asked for more time to prepare the necessary documents and have them filed in court.

Lawyer Bitta said that the 239 passengers should be enjoined in the proceedings as the court order issued last week is against parties who are not yet parties to proceedings.

“It’s important they be enjoined. The orders also limit entry of Kenyan citizens emanating from certain countries going by the way they have been framed,” Bitta said.
