High Court dismisses Harun Mwau’s poll case

The High Court has ruled that it has no jurisdiction whatsoever in a case filed by Harun Mwau seeking for postponement of the October 26 repeat presidential election.

Justice Chacha Mwita said that the court lacks the constitutional mandate over the matters raised in the petition that wanted tomorrow’s (Thursday, October 26) fresh poll postponed on account that fresh nominations had to be conducted first before Kenyans could cast their votes.

“The petitioner referred to orders of the Supreme Court which annulled the August 8 presidential election. The issues of the case touch on presidential election and therefore should only be dealt with by the Supreme Court,” said Justice Mwita.

Mwita further cited that article 163 (3)(A) of the constitution gives only the Supreme Court the original jurisdiction to hear and determine issues of presidential election.
