High Court sets hearing dates in Albert Ojwang murder case

Justice Diana Kavedza on Tuesday directed that the case will be heard on March 17, 23, 24, 30 and 31, citing the matter’s public interest and the need for expeditious determination.
The judge ordered all parties to comply fully with case management directions to avoid delays.
The court further directed investigators and the Office of the Director of Public Prosecutions (DPP) to supply the defence with witnesses’ statements and all relevant video evidence within set timelines.
Protected witnesses are expected to testify during the first two days of the hearing. By consent of all parties, the court ordered that proceedings will commence on March 17, with five witnesses bonded to testify on the opening day.
Justice Kavedza also instructed the DPP to share in advance the names of the initial prosecution witnesses to prevent confusion during the trial.
The defence was directed to adequately prepare its line of questioning, while the prosecution confirmed it would present CCTV footage as part of its evidence.
The case involves former Central Police Station Officer Commanding Station (OCS) Samson Talaam, Police Constable James Mukhwana, and four other co-accused persons charged with the murder of Ojwang.
Last year, the court denied the accused bail, citing the risk of interference with both civilian and police witnesses, as well as the heightened public interest surrounding the case.
“The scale of public unrest following the deceased’s death constitutes a compelling reason to deny bail,” Justice Kavedza observed, noting that Ojwang’s death in police custody in June triggered nationwide protests and destruction of property.
The six accused persons remain in police custody as they await the commencement of the hearing.
