Jaguar’s 2017 charges of ‘causing death’ return to haunt him

The Prosecution on Thursday sought to have Starehe MP Charles Njagua aka Jaguar detained for 14 days after he was arrested over alleged incitement.

According to the State lawyer Duncan Ondimu, if the respondent is released, there is a likelihood that the case will be interfered with.

“… it is important for the court to be aware that he’s a convict..he was sentenced on 21st this year on two counts of causing death by dangerous driving…if released in bail he might commit further crimes,” the advocate said.

According to the charge sheet, Jaguar was accused of reckless driving on March 21, 2017 causing the death of Mugo Mwangi, a motorcyclist.

A Range Rover with Reg. No. KCB 808J was said to have hit and killed the rider and his passenger on Sagana-Makutano road within Kirinyaga County.

According to eyewitnesses, the vehicle was headed towards Makutano when the female driver lost control.

However, in a statement to the police, Jaguar insisted that he was the one driving the vehicle.

The following day, Jaguar took to social media to express his condolences to the family of the deceased.

In court on Thursday, the Prosecution said it is this case that warrants a denial of bail and he should be detained at the Kamukunji Police Station.

Ondimu told the court that at the time of his arrest, the MP had been allegedly planning to organise gangs to attack foreigners.

The Prosecution further stated that Jaguar’s ‘inciteful’ remarks have caused a serious diplomatic challenge placing Kenya’s relations abroad at risk.

Plain clothes policemen handcuffed him outside Parliament buildings on Wednesday and took him to Kileleshwa Police Station where he spent the night.

This came moments after the lawmaker took to social media to apologise over the controversial statement that Ugandans and Tanzanians have taken over businesses in the country and should be forcefully removed.

His lawyer Okachi however opposed the Prosecution’s plea for detention saying that it will be cause chaos.

“..there are traders there …commotion will be there …the prosecution want the court to help them get evidence,” Okachi said.

The lawyer also insisted that Jaguar has no powers to influence the Communications Authority as they have his cell phones and he has no powers to influence the Directorate of Criminal Investigations.

The court was also told that Jaguar was arrested outside Parliament where he was ‘discharging his duties’ and his constituents are likely to suffer if he is further detained.

His defence team has asked that their client be given bail with conditions and if he violates them the court can give further directions.
