The commission has taken note of the several video clips posted on social media together with phone recordings released by Sonko against justice Chitembwe.
He is expected to appear before the commission within seven days so as to record his statement.
"...JSC will require your personal attendance to testify as a witness in the aforesaid matter which will proceed for oral hearing on Tuesday, December 14, 2012,” reads the notice.
On Wednesday, a second petition was filed before the court seeking the removal of justice Chitembwe from office.
The petitioner; Francis Wambua, accused the judge of gross misconduct, judicial incompetence, malice, conflict of interest and corruption.
Part of the details contained in the petition include audios and videos secretly recorded by Sonko, that he has been releasing on social media, dubbed ‘sonko leaks’. A Nairobi court has since barred Sonko from further releasing the videos.
Sonko, while supporting the petition, claims his friction with Chitembwe began from ownership of a disputed parcel of land in Kwale County, that was the subject of a petition filed by Imrad Beige and David ole Kilusu, who accuse the judge of gross misconduct and judicial incompetence.
The former governor wants JSC to recommend to the president, establishment of a tribunal to oust Chitembwe, who he claims demonstrated open bias, malice and ineptitude in the conduct of proceedings before him, and churning questionable judgments.
On Monday this week, Chief Justice Martha Koome said the JSC had deliberated on the petitions against justice Chitembwe directing that they are served upon the judge for his response within 14 days.
