Judiciary has over Ksh.41M unclaimed cash bails, other assets

The Kenyan Judiciary has called upon individuals to collect their assets in the form of cash and properties after the conclusion of their court cases.

The said unclaimed assets include cash bails which are deposits in security to have accused persons released, deposits in the form of properties in civil matters, awards in children cases where parents are at times ordered to deposit cash with the court for children maintenance, workman compensation in employment and labor cases. Once the cases are over depositors are required to collect their assets.

The judiciary has collected a total of Ksh.5.1 billion for both ongoing and concluded cases for the year ending October 31, 2023.

According to Caroline Kabucho, the Registrar of Magistrate and Kadhi Courts, case matters settled as of October 30 accrued to Ksh.41.4 million for matters concluded for a period of one year.

Kabucho says the assets will be transferred to the Kenya Assets Recovery Authority (ARA) should the owners not claim within the slated timing.

However, even when the possession is transferred to ARA, the registrar reiterates that the depositors can still go with the case number , deposit receipt, and National ID.

Also unclaimed are several assets deposited inform of log books and title deeds whose value is yet to be determined.
