Karua slams DCI over missing blogger: ‘Produce Ndiangui, that’s why we pay you’

NARC-Kenya leader Martha Karua has sharply criticized the Directorate of Criminal Investigations (DCI) for what she describes as flagrant defiance of court orders in the case of missing blogger Ndiangui Kinyagia.

Karua accused the DCI of failing to produce Kinyagia, despite an active habeas corpus application and growing public concern.

“There has been no compliance. They are not taking the orders of this court seriously,” said Karua. “It is their business to find him — that’s why we pay them.”

In a sworn affidavit, Sergeant Samuel Itegi, a DCI officer, stated that Kinyagia had not been arrested and was not being held by the agency.

The affidavit described claims of the blogger being held incommunicado as “malicious, unfounded, and baseless.”

The DCI's affidavit also revealed that intelligence received on June 20, 2025, linked Kinyagia to online posts allegedly inciting the public to storm State House—actions that investigators claim violated the Protected Areas Act.

The posts were traced to an account on X which had earlier shared a protest timetable for what was billed as a peaceful demonstration in memory of Gen Z protesters killed during last year’s June 25 protest outside Parliament.

Officers claim they tracked Kinyagia to an apartment in Kinoo, but found it locked. His phones were reportedly off.

According to the affidavit, a search was carried out without a warrant on the night of June 21 under Section 60 of the National Police Service Act. Laptops, mobile phones, passports, and other personal items were seized during the operation.

The search was witnessed by the building's caretaker, who stated Kinyagia had earlier left with a man and two women.

Karua, however, questioned the integrity of the DCI’s account, alleging that the affidavit may contain misleading or even forged elements. “We have noted several differences,” she said, pointing to inconsistencies in the agency’s documentation and timeline of events.

She also criticised the DCI for choosing to address the matter through a late-evening public denial rather than appearing before the court. “He appears before the public to deny holding Ndiangui, but can’t come to court and explain himself? That’s sub judice,” she submitted.

Arguing that responsibility for the blogger’s safety and whereabouts lies squarely with the state, Karua reiterated her demand: “Produce Ndiangui. That’s your job. That’s why we pay you.”

Meanwhile, the DCI, through its legal counsel, urged the court to dismiss the habeas corpus application, maintaining that Kinyagia was not in state custody.

“The second respondent did not arrest the second petitioner. He is not in the hands of my client,” the lawyer stated.
