Kidero Sued Over Garbage By Activists

Activists Benjamin Ndolo Wambua and Victor Oluoch moved to court seeking information from the city Governor over payment made to a garbage collector.

The two allege that the County Government of Nairobi made fraudulent payment to a bank account of a private limited company.

They further want the court to order the Co-operative Bank of Kenya to produce bank statements for the said company for inspection.

The activists, who appeared before High Court Judge Mumbi Ngugi, alleged that the County Government of Nairobi, led by Governor Kidero, paid Ksh 7.6 million to Peposi Freighters Limited only four days after it was incorporated as a Limited Liability Company.
The court was informed that the firm opened a bank account on December 16th, 2014 and the deposit made four days later at its City Hall Branch.

FRAUDULENT TRANSFERS

Anthony Kago, the legal cousel for the activists, told the court that the company is alleged to have been awarded a tender and contracted by the county to collect garbage within the city.
"It defeats logic how Peposi Freighters Limited was contracted to collect garbage four days after its incorporation and further render to the county services worth Ksh 7.6 million within four days of incorporation," read the petition.

In a sworn affidavit, Ndolo said that on January 20th, 2015 he wrote to the Ethics and Anti Corruption Commission (EACC) requesting the anti-graft agency to furnish the court with all the information under its custody touching the fraudulent transfer of the county government.

He further alleged that the firm won garbage collection tender with the county before it was registered.

"On a curious note, how did Peposi Freighters Limited win a tender, entered into a contract with the county government and went further on to execute the same while it was not in existence?"

The matter will be mentioned on March 17th, 2015.
