Kisii politician Naftali Ontweka to be buried in Kamulu after 9-month court battle

The Court
of Appeal has ruled that the body of former Borabu parliamentary aspirant
Naftali Ontweka in Kisii County be released to his widow Zipporah Masese
Ondieki and be buried in Kamulu.
The
deceased died last year in April, but his brothers moved to court and
challenged the decision to have the body interred in Kamulu.
While his widow wanted him buried in Kamulu as it was their matrimonial home, his brothers wanted him buried in Kiango, Kisii County where he also had a home.
The
court while dismissing the appeal by the three brothers ruled that the appeal lacked
merit, and dismissed it in its entirety.
Further,
the court noted that the three brothers are at liberty to attend the burial and
perform the Gusii customary rites.
“For
the avoidance of doubt, the body of the deceased shall be released to Zipporah
Masese Ondieki, the respondent. The appellants are at liberty to attend burial
and perform the Gusii customary rites,” reads the Court of Appeal decision.
