According to the Office of the Director of Public Prosecutions the incident happened on the evening of October 15, 2021, following the minor's attendance at a family funeral.
Court documents indicate that the accused, a neighbour the minor knew, reportedly enticed her outdoors while she was serving guests at her house by posing as a questioner.
The girl was rendered unconscious by the man before she was defiled, the court was informed.
After recovering consciousness, the victim resisted and was able to escape back home. After reporting the crime, the suspect was taken into custody.
Delivering the verdict, Kajiado Principal Magistrate Susan N. Mwangi noted that the prosecution had proven the case beyond reasonable doubt.
Given that the complainant knew the suspect well, the magistrate rejected the accused's claim that he had been set up, finding that the evidence was solid and did not allow for mistaken identity.
In addressing mitigation, the court denied the accused's request for mercy on grounds that he was a father and the only provider for his family, stressing that these considerations did not offset the seriousness of the offence.
