MP Oscar Sudi skips hearing in forgery case, court told he’s in Turkey

Kapseret Member of Parliament Oscar Sudi’s lawyers have been ordered to tender evidence showing that the lawmaker is out of the jurisdiction for treatment.

This is after Sudi failed to appear in court on Wednesday for the hearing of his forgery case, with his lawyers seeking an adjournment claiming he is in Turkey.

The court however said the evidence presented by the legislator’s lawyers to back their claims did not disclose the details of the hospital in Turkey where Sudi is allegedly receiving treatment.

Trial Magistrate Felix Kombo also stated that grounds for adjournment because it's election time does not hold any merit.

The court further directed the lawyers to get instructions from Sudi whether the matter can go on without his presence.

Magistrate Kombo said the matter is from 2016 and that the last time a witness testified in court was in 2021.

In the case, Sudi is charged with forging a Diploma Certificate in Business Management from the Kenya Institute of Management (KIM).

In March this year, the Kapseret MP failed to show up in court after he told the court that he allegedly contracted COVID-19.

John Kutima Matseshe, who was head of examination at KIM, previously told the court that the diploma certificate Sudi claims was issued by the institution is not a genuine document.

He testified that the number 36262 on the certificate presented by Sudi belonged to a certificate issued to one Elkanah K. Kimutai of admission number NRB\20870 of Diploma in Purchasing and Supplies Management which was issued on September 24, 2009. 

Sudi’s purported admission number NRB/20879, it also emerged, belongs to one Scolastica Achieng Odhiambo of Diploma in Management of NGOs who was registered in 2005. 

Kenya National Examinations Council (KNEC) Principal Examinations Secretary Nabiki Ene Kashu also previously told the court that the legislator did not register or sit the 2006 KCSE examination at Highway Secondary School in Nairobi.

She testified that the purported certificate for the 2006 exams presented to KNEC by Sudi for verification was a forged document.

“We also established that a candidate by the name Oscar Sudi did not appear in the year 2006 KNEC database for either Highway or Parklands Secondary School,” she testified.
