Nandi Senator Samson Cherargei to spend the weekend in police cell

Nandi Senator Samson Cherargei will now spend the weekend in police custody after a Nairobi court pushed the hearing of his ethnic contempt case.

Cherargei was on Friday presented at the Milimani Law Courts after a warrant of arrest had been issued against him for failing to appear for hearing of the case on April 19, 2022.

The Senator, who was arrested on Thursday and spent the night in police cell, through his advocates presented a document before the court indicating that he was unwell.

The advocates told the court that Cherargei fell sick on April 17, 2022 and went to seek medication in Eldoret, where he was advised to take bed rest for 7 days.

The prosecution however questioned the document saying it was written in Chinese, with the magistrate even making fun of it as she was unable to read it.

Cherargei was sent to police cells on the basis that the trial magistrate was not present, and that the prosecution failed to agree with the defence on his release terms.

Milimani Senior Principal Magistrate Esther Kimilu, who was standing in for Chief Magistrate Wendy Micheni, directed that the accused be remanded at Gigiri Police Station.

Magistrate Kimilu set mention of the matter for Monday, April 25, for Trial Magistrate Micheni to deal with the matter in-person.
