The 10 inter county secondary schools affected are Kangubiri Girls, Nyeri High, South Tetu Girls, Tumutumu Girls, Karima Boys, Chinga Boys, Chinga Girls, Othaya Girls, Narumoru Girls and Othaya Boys.
Justice James Wakiaga gave the order after Nyeri County Government moved to court over the alleged unlawful admissions
This signifies that the county government has won round one of the suit.
The County Government through their lawyer Wahome Gikonyo argues that the 40:40:20 Education Ministry policy was not adhered to.
Education Cabinet Secretary Jacob Kaimenyi and His P.S Richard Beliyo Kipsang who had earlier been summoned to appear in court to explain why there were anomalies instead sent their lawyer Alex Muthuri from AG's chamber.
Muthuri said Kaimenyi and Kipsang need more time and requested more time to Friday this week to file their affidavits which will be tabled in court as their evidence.
Meanwhile, over 2, 200 positions will be affected after today's ruling.
In the suit, the Cabinet Secretary and his PS are accused of abetting the flawed selection process, which gave the lion share of the form one places in the extra-county schools to outsiders.
The government says the county is legally entitled to 60 per cent of the slots, but got less than that across all the 14 extra-county schools.
Nyeri Governor Nderitu Gachagua who spoke outside the court said justice must be done in order to allow the students to be admitted in their rightful schools.
The court will have full hearing on 7th February 2014.
