Nyeri MCAs want Executive Members vetted afresh

A section of Nyeri Members of the County Assembly (MCAs) are now demanding the five county executives be vetted afresh saying they ceased to hold office after the death of Nyeri Governor, Nderitu Gachagua.

Speaking when discussing the Speaker’s Order on Attorney Genera’s advice on the CECs, Wamagana Ward MCA, Jesee Mwangi Kamuri, argued that the new members of the executive committee are required to be approved by the County Assembly.

He said that they need to subscribe to the Oath of Office as provided in Article 74 of the Constitution and as by the First Schedule of the County Government Act.

In addition, Mr Mwangi argued that they have nothing against the CECs but the law must be followed as stipulated in the Kenyan Constitution.

He also insisted that in case Governor Samuel Wamathai, who took over from Mr Gachagua, follows the AG’s legal opinion, they will move to the Supreme Court to challenge the decision.

Jesee, who is also the Chair of the County Assembly Legal Affairs Committee, reported that they suspect that the legal opinion from the AG has been doctored alleging that some executives who were in the old cabinet fear to be vetted afresh having not delivered in their duties.

Baragu Mutahi, Mathari Kiganjo Ward representative, contributed to the afternoon session, saying that the new Governor, Ambassador Samuel Wamathai, should appoint new executives and present them immediately to the County Assembly for vetting.

He also faulted the AG on his opinion on the re appointment of the CECs with the new government, saying that the AG’s legal opinion states that the old cabinet should continue serving.
