Josphine Kabura, a businesswoman, and four others linked to the graft have a case to answer and will have to defend themselves.
Trial magistrate Wendy Micheni declared on Monday that there was insufficient proof presented by the prosecution to connect them to the theft.
The magistrate also stated that the prosecution relied on general information that was not supported by electronic or documentary evidence.
"Having failed to establish a prima facie case against the accused persons, i hereby acquit them for lack of evidence," the magistrate ruled.
The prosecution called more than 50 witnesses to testify against Mangiti and others.
In 2015, the accused denied the charges of conspiracy and money theft.
