Petition filed seeking action against Senator Linturi over deaths of his house help, business associate

A Meru-based activist on Wednesday filed a petition in court seeking to compel the Directorate of Criminal Investigations (DCI) and the Office of the Director of Public Prosecution (ODPP) to investigate and prosecute Meru Senator Mithika Linturi for various offences.

Michael Makarena, through lawyer Danstan Omari, stated that the legislator has had brushes with the law several times, yet he seems to walk away scot free.

Makarena wants the DCI and ODPP to arrest and prosecute Senator Linturi for various offenses including alleged forgery of his academic papers and involvement in the unresolved murder his late business associate and house help.

Court papers seen by Citizen TV question why the lawmaker has never been prosecuted despite an inquiry into the death of Linturi’s business associate Dr. Stanlely Maore pointing to the possibility of foul play.

“The then magistrate arrived at a conclusion that there was some serious business disagreements between Mithika Linturi and the deceased that probably might have caused the killing of the businessman, Stanley Maore,” said one of the lawyers.

The petition also details that that the State should investigate whether Linturi has a degree from India, saying he defrauded his way to a Masters class at the University of Nairobi without an undergraduate degree.

“You cannot be seeking to get a Masters degree if you have grade D in Form Four…you can’t, minimum entry requirement is a C+. Two, you must have a degree as a basis for that,” said lawyer Omari.

In his petition, Makarena also wants the State to investigate the circumstances under which a house help died in Linturi’s house, claiming that suspects and witnesses in Meru town recorded statements except the Senator despite being the immediate employer.

According to court papers, no postmortem was done on the house help’s body.
