Petitioner in NTSA Director General case now says life in danger

A petitioner in a
case seeking orders to compel the National Transport and Safety Authority
(NTSA) to recruit competent individuals for the position of Director General
now says his life is in danger.
Although he was
represented in court by a lawyer, the petitioner was given an opportunity to
address the judge.
Edwin Oduor told
Justice Byram Ongaya that he has not seen his family for long and is living in
fear because of the pending case.
However, lawyers
representing NTSA told the court that the petitioner’s arguments are sideshows
and should not be entertained.
The judge directed
that the application by the petitioner dated November 17 last year be heard on
March 12 this year.
In the
application, Oduor argues that an agreement giving green light to NTSA to
recruit a new boss after the lapse of the term of current Director General
George Njao is prejudicial.
“Given the
foregoing and coupled with the issue of representation that the subject adopt
consent touches on an issue of public interest and by extension the livelihoods
of the petitioner and that of his family who he has been separated from because
of their safety in view of the existence of the case,” read the application.
Oduor wants the
court to vacate the consent claiming that the respondent may go on and
re-install Njao to the position of NTSA Director General.
The court directed
the first respondent to file his objections and serve by February 18. The second
respondent in the case however consented to the application saying he will not
be opposing it.
Justice Ongaya
early this year issued a ruling giving green light to NTSA to recruit anyone
but comply with the law.
