Police officer Ahmed
Rashid will take a plea on Friday after High Court Judge Kanyi Kimondo dismissed
his application that sought to have the plea taking stopped until a matter
filed is heard and determined.
Rashid had argued
that he has been a police officer for nearly 22 years and that he is a law-abiding officer who has never misused his firearm.
He told the court
that he has never been summoned by the Independent Policing Oversight Authority (IPOA)
and learnt of the matter through social media.
"Regarding the
incident in the issue of 2016, the two were killed in the cause of robbery, they
were dangerous and had attacked police officers," the court heard.
On its part, IPOA
argued that it conducted its independent investigations upon review and recommended
that the alleged killer cop be charged with murder.
However, the court
noted that it can't encroach on the independence of the Director of Public
Prosecutions (DPP) and therefore dismissed the notice of motion by Rashid.
Sergeant Rashid is facing murder charges over the March 31, 2017 killings of two suspected thugs in Eastleigh; an incident that was captured on camera.
The Eastleigh business community, which has a membership of 24,000 people, has since urged the ODPP to drop the charges against officer Rashid saying he acted within the law.
