Police officer Rashid Ahmed files application seeking review of murder charges

Sgt. Rashid Ahmed Hassan has filed an application seeking to have the DPP review murder charges against him.

The IPOA summoned Rashid last week to appear in court and enter a plea on December 8 for the alleged murders of Jamal Mohammed and Mohammed Dhair Kheri.

The alleged crime was committed on March 31, 2017, at Amal Plaza in the Eastleigh neighborhood.

He claims that if the court does not intervene, he will be brought before the court for a plea hearing on December 8, 2022, violating his right to administrative action that is reasonably fair.

"That the petitioner is bewildered by the turn of events and has well-founded fear that the respondents are not acting in good faith and have bad motive in their decision as he has never been summoned to give any account on the allegations over which the  respondents obtained summons thus a well choreographed plan to fix him without any lawful basis," reads court papers

Respondents in the case include IPOA, DPP, IG, and Eastleigh Business Community.

Rashid claims that on the fateful day, he was in the area of First Avenue in Eastleigh when word of an ongoing robbery at Amal Plaza in Eastleigh was broadcast over the police radio.

He later learned that the robbery was being done at a stall belonging to Al Nur Osman through a police report made by the victim.

Immediately, he rushed to the scene of the robbery as part of his lawful duty to maintain law and order and came to face with the armed robbers.

"That the petitioner and his colleagues had been trailing the robbers, who on the same date of the incident had robbed several known persons."

"That besides the petitioner there were several other police officers who had heeded the signal at the scene of robbery," he says 

Rashid claims that he and his colleagues found the Somali sword and knives that had been used in the robbery in addition to a homemade gun that could fire.

"That the armed robbers who were about seven in number shot at us and members of the public. In a bid to protect lives, one robber who was carrying the homemade gun was gunned down in the heavy exchange of gunfire. One of the robbers upon realizing that he was cornered tried to snatch a firearm from police officer.

In the ensuing scuffle, he was also shot and neutralized.,"reads the application.

He says that the night before the incident they had robbed AlNoor Guleed his mobile phone and 200,000 shillings . They had stabbed him of his Samsung phone
