A Nairobi court acquitted Private Detective Jane Mugo of threatening to shoot a businessman.

The court determined that the the prosecution had failed to prove its case against the controversial spy.

Susan Shitubi, the senior principal magistrate, ruled that the prosecution failed to prove the case against Mugo.

The court noted that there were inconsistencies in the testimony of the two witnesses presented by the prosecution.

 Shitubi found that the alleged pistol was not recovered when police raided Mugo's residence.

She said the inconsistency by witnesses who were not cross-examined left the court juggling on who to believe but left with only the option of believing the defence side.
