Prosecution seeks 14-day detention for police accused of killing two in Eldoret

On Monday, prosecution counsel Eric Kiama told senior Principal Magistrate Mogire Onkoba that detectives were seeking to continue holding police constable Eric Kirui for two more weeks, noting that detectives had raised compelling reasons that warrant his detaining.

Kiama has averred that once investigations are complete, the officer will face murder charges contrary to section 204 of the penal code.

Kirui, an officer attached to Tembelio police station in Moiben sub-county is said to have shot and killed his girlfriend Caroline Malakwen and a man identified as Ignatius Kipchumba using his assigned AK 47 rifle on the night of June 26 at Kokwet club owned by the deceased woman.

The prosecution had argued that the murder weapon used by the suspect had yet to be subjected to a ballistic examination at the Directorate of Criminal Investigations (DCI) headquarters in Nairobi.

He added that postmortem reports are yet to be received and that key witnesses are yet to record their statements.

Kirui’s lawyer Stephen Ombego had vehemently opposed the application to detain his client, claiming that his constitutional right to secure freedom on bond should not be curtailed.
