Show us one Form 34A in the portal that differs from the hard copy - Fred Ngatia to Azimio

Lawyer Fred Ngatia has challenged the Azimio la Umoja One Kenya Coalition party to prove that the soft copies of Forms 34A differ from the hard copies.

Speaking in defence of President-elect William Ruto at the Supreme Court on Thursday, Ngatia dismissed claims by Azimio leaders Raila Odinga and his running mate Martha Karua that the presidential results forms from the IEBC were intercepted and altered in favour of his client.

He instead labelled SC James Orengo’s submissions as a mere conspiracy that lacks any physical grounds in the court.

“Show us a ballot box that people from outer space came and voted into, stuffed into it and then all this hijacking in mid-air took place? There is no such evidence because that is a work of fiction. Not just conspiracy but work of fiction,” said Ngatia.

“The lawyers' argument is based on certain planks…one of them is that Form 34A was hijacked mid-air, altered, votes from one candidate, leading petitioner, removed and added to the votes of 1st respondent,” Ngatia submitted.

“If that is true, from a point of logic, show us one form 34A in the public portal which differs from the hard copy at the polling station, show us only one.”

He added: “Or show us a ballot box that people from outer space came and voted into, stuffed into it and all this hijacking in mid-air took place. There is no such evidence because that is the work of fiction.”

Ngatia thus called on the court to moderate the excesses in the political contestants which he identified as imagining that the court can now take the role of the voters to do the coronation of any candidate.

This, he said would lead the country into a constitutional crisis as he reiterated that the case should have already been determined by the voters who are the electorates.

“These consolidated petitions arise from a political presidential election contest which should ideally be resolved by the electorate, the Kenyan voters, not by a court of law,’ he noted.

In his submissions on Wednesday, Orengo who represents Azimio said that IEBC chairperson Wafula Chebukati had provided conflicting figures regarding the cast ballots and those who were recorded in the final results.
