Supreme Court to deliver full judgement of presidential election petition next week
The
Supreme Court is set to make public its full judgment regarding the August 9 presidential
election petition on Monday next week.
According
to a notice issued by the apex court on Saturday, the seven-judge bench will deliver
a detailed ruling following their decision to uphold President William Ruto's victory early this month.
The
pronouncement, the notice signed by Supreme Court Registrar L.M Wachira stated,
will be made through email.
"Take
notice that the reasons for the judgment of the court, that was delivered in
this petition on the 5th of September 2022 will be delivered on Monday 26th
September 2022 at 2: 30 PM through email," stated the Registrar.
In
the election case, a total of nine petitions had been filed, with eleven people
listed as respondents in presence of three independent legal bodies (amici
curiae) led by the Law Society of Kenya (LSK).
During
the initial abridged ruling, Chief Justice Martha Koome read out the court's
unanimous decision dismissing all the nine petitions, among them that filed by Azimio
la Umoja One Kenya coalition party chief Raila Odinga and his running mate
Martha Karua.
The
CJ stated that the 7-judge bench had failed to find electoral malfeasance to warrant the nullification of the polls.
"This
is a unanimous decision of the court and we make the following orders; The
presidential election petition number E005 of 2022 as consolidated with
presidential election petition numbers E001, 2, 3,4,7 and 8 of 2022 are hereby
dismissed," she ruled.
"As
a consequence, we declare the election of the first respondent as
President-elect to be valid under Article 143 of the Constitution. This
being a matter cutting across the public interest, we order that each party
bear their own cost. It is so ordered."
