Tob Cohen case: Court told of push to arrest lawyer Murgor, contents of 3 separate wills

It has now emerged that Director of Criminal Investigations George Kinoti had sought warrants of arrest against Lawyer Phillip Murgor for allegedly forging the late businessman Tob Cohen's last Will.

Murgor told a Nairobi court that there was a letter written by George Kinoti to the Director of Public Prosecutions (DPP) seeking for his arrest but the DPP declined the request.

While cross-examining Tob Cohen's sister Gabriele Van Straten, Lawyer Murgor asked the witness why she had asked for his arrest yet there was no evidence submitted before the court. Directing the witness, Murgor read a letter dated September 10, 2021, written by DCI by the DPP, the DCI applied for a warrant of arrest against Murgor.

“This is a murder case where an innocent person was cruelly murdered in cold blood. The spirit of the innocent soul will haunt anybody who may interfere with justice in bringing to book any person who was involved in the heinous act,” Murgor read out the letter.

Murgor asked the witness if he wanted him arrested and without mincing her words Gabriele said YES.

According to the letter, Murgor was summoned to appear before the DCI offices to be interviewed regarding a will that is suspected to be a forgery but Murgor allegedly declined to honour the summons.

“Unless the Will is forensically determined genuine or forged, the status as sought by the suspect counsel will not only compromise the in-going murder case but collapse it completely," reads the document.

In today’s hearing the court was also told that there are three Wills being disputed, two have been presented by Sarah and one presented by Gabriele.

In the first Will, the late Cohen allegedly gave all his property to his wife Sarah Wairimu and stated that in case Wairimu dies their only daughter Renee should inherit and in case all of them died then Gabriele will inherit,

In 2018 he amended the Will and put his brother and sister as executors with Sarah inheriting shares at this company, bank balances but their property along Farasi Lane was to be divided four times between Sarah, his daughter, nephew and niece.

The late tycoon allegedly reviewed the Will on 30th April 2019 where he bequeathed everything to his sister and Wairimu was left with nothing. 

Gabriele who refuted claims that together with the DCI had arranged to have the Judges and defence lawyers phones tapped has through her lawyer Danstan Omari made an application to have communication between the late Cohen and her through email,  where the brother expressed fears of being killed by Wairimu be enjoined in the case. 

Gabriele further denied that she had a motive to kill her brother because of the wealth.


The hearing of the case continues.
