Tuju seeks anticipatory bail, says he is ‘under constant threat of arrest’

In an ex-parte application, Tuju claims that he was followed by unmarked vehicles on March 21 and forced to abandon his car to seek refuge at a secure location.
He later reported to Karen Police Station to record a statement, but alleges he was manhandled by officers, aggravating injuries sustained previously in an aeroplane and motor vehicle accident.
Tuju is also seeking the High Court to restrain the Inspector General of Police, the Directorate of Criminal Investigations (DCI), and the Directorate of Public Prosecutions (DPP) from summoning, arresting, or interfering with his freedom of movement, and ensure he can receive medical treatment free from intimidation or police presence.
Tuju was transferred to Karen Hospital on Tuesday morning, where he remains under continuous police guard, despite not being formally charged.
The former CS argues that such custodial control in a hospital setting is inhumane, unjustified, and violates his right to liberty and medical care.
Tuju’s legal team argues that he is a law-abiding citizen willing to cooperate with authorities once proper legal procedures are followed.
The application, filed under a certificate of urgency, stresses the pressing nature of his medical condition and fears for his safety.
"In the event the 1st applicant is granted bail, he is willing to appear in court or the police once he is summoned," reads court papers.
