Two men accused of mimicking Uhuru, conning Merali may have bail revoked

Two suspects out of the seven who are believed to have mimicked President Uhuru Kenyatta and allegedly swindled Sameer Africa Group boss Naushad Merali risk having their bail cancelled.

This could be the case if they are found to be in contempt of court for failing to appear before the investigation officer as they had been directed.

On Thursday, a complaint was presented before Chief Magistrate Francis Andayi through the prosecuting counsel Edwin Okello.

The court heard that the first and second accused persons; Joseph Waswa and Duncan Muchai never appeared before the police for an entire week contrary to the magistrate’s order.

They claimed that the investigating officer granted them permission to be away and that they were in the company of their advocate Cliff Ombetta.

However, the prosecution counsel distanced himself from the claims and denied that he had given any such authorisation.

The Chief Magistrate has indicated that he will get to the bottom of the matter to determine who, between Ombeta and the investigation officer, is lying to the court.

The issue could not be determined immediately as Ombeta was said to be handling a different court mater in Malindi.

The seven accused persons are said to have falsely pretended to be in a position to sell to Sameer Africa Group a piece of land LR No.10090/118 situated in Milimani area,Nairobi.

They denied the allegations and were released on a cash bail of Ksh.100,000 each on condition that they be reporting to the investigating officer for three weeks consecutively.

They include Waswa, Muchai, Isaac Wajekeche, William Simiyu, David Luganya, Gilbert Kirunja, and Anthony Wafula.

They were charged with fraudulently obtaining Ksh.10million from Akif Hamid Butt, the Finance Director of Sameer Africa.

The seven are required to report to the Directorate of Criminal Investigation every week until the lapse of the three weeks since they were charged.
